I am selling my 2015 Caterpillar D10T2 to a buyer residing in your state. I will need your skilled legal counsel to help me draft the sale agreement for the transaction from contract preparation through closing. The above mentioned 2015 Caterpillar D10T2 has a sales price of $876,000. This includes the insurance cost, shipping and handling cost. I got this one as well. I terminated my agreement without proceeding with the "transaction." I was never contacted by the alleged broker.

This same scammer sent me a PDF draft contract which I opened. Have I opened myself up to any of the phishing risk here? I have stopped answering him. Ran an anti virus scan and did not see anything

We received the same email this morning. Thankfully we knew it was a scam immediately and did a google search before ever replying.
ReplyDelete"Allen" reached out to me back in April to help him with this Caterpillar sale. Recognizing the scam, I figured I would see how far he would go to prove his bona fides. I quoted some ridiculous fee, which he agreed to. In the retainer agreement I sent him I indicated the fee was "earned upon receipt" and required a certified check. I never heard from him again until this week, when he sent the introductory letter all over again. I think he needs a better CRM system.

ReplyDeleteWe just received this email today at 4 p.m. CDT, August 24, 2021. It had scam stink all over it -- after all, why would a Florida company reach out to a Minnesota firm for a simple purchase agreement?

Received this in Canada several times. Always a different name but from a FL company. Same person or group doing this en masse to all of the law firms using the same MO.

Individual and company are legitimate. Thankfully this site alerted me of the red flags (i.e., purchase agreement and caterpillar). Same email as post by Anonymous on June 25, 2021 at 5:39 AM above using a different name (Louis Babin instead of Allen Jason). Be careful out there!
NY Attorney here. I just got the same email. What is the scam though? I read through this thread and it doesn't seem like anyone here has identified or theorized of what the scam actually is...Babin is not asking for any money, etc?
ReplyDeleteThe Client you hire immediately discovers that the matter has been settled and they are going to send you a check. The other side sends you a cashiers check (far in excess of what your fees are). You deposit the check in your IOLTA, and it clears. They ask that you wire the excess funds to them in China/Canada/Mexico/India. Your bank discovers that the cashiers check is bad. You have massively overdrawn or depleted your clients funds.
DeleteSo far, the courts have held that the attorney/firm is responsible for the loss, not the bank. The courts hold that the attorney is in the best position to "know" his client and whether they are passing fraudulent checks.
