  5. Received the same email, purportedly from a David Spitz. Sent a check for $250,000, from which retainer was to be deducted, drawn on a Canadian bank, from a Canadian medical supply company, with a letter purporting to be from the NYC broker. So many red flags. They (or others) are still churning the same scam, as a colleague just sent me a "referral" from the same alleged person. Different email address but same name and text. They often use stilted language such as "Dear Attorney [firstname] [lastname]." Thanks for providing this blog. Very helpful to the fraud prevention and legal ethics communities.

    "It looks like we have a serious customer in our hands. I will review the LOI carefully and give you my thoughts about the offer tomorrow morning.

    
The broker just notified me that their offer deposit check was received in your office this afternoon through FedEx . Kindly send me copies of the documents you received.

    I assume they expect you to cash the check, then transfer them "Inspection Funds" only to have the check bounce several days later? Quite ornate if you ask me... they even had a separate email send and LOI.

  10. I just got the same email from David Spitz, VP of FMG Exploration. I looked up the website. It looks real, and yet is nearly contentless. Just real enough to fool the (mostly) disbelieving.

    Like another commenter, mine came by way of an alleged referral from another attorney (who didn't remember making the referral).

    Whenever they use terms like "from your jurisdiction" that is an immediate red flag to me. Yet, I spend time trying to figure out if it is legitimate, not wanting to be unresponsive to a real potential client.

    As soon as I got the company information, it took just a few clicks to find it was a scam. Beware and always do your due diligence in screening potential clients. Don't jump at the money. Also, pay attention to the email addresses - the initial email came from a comcast account, yet the reply email cam from fmgexploration.com (the alleged company).

    red flags: contains awkward syntax; didn't mention source of referral; didn't seem to know there is a difference between real estate/office lease (my practice) and equipment leases; reference to covid "outbreak" seemed dated and not quite right; the phrase "my week is looking tied" is off; and request for a retainer agreement before even speaking on the phone is pretty suspicious.

    This is definitely better quality scam compared to others.

I replied again and told them I'd need to do minimal industry standard due diligence requiring their EIN, W9, Secretary of State formation documents, and a letter of good standing. No response.

Local corp has been around 20 years, almost certainly has general counsel or local counsel that MOSG's attorney should contact.   52. As of April 2023, this scam is still being run with identical email content (save the names of individuals and the companies - mine is Donald Huxley with MOSD Exploration LLC from OK for a lease with a Dallas, Texas company).

    I too thought the initial email was odd (from a gmail account), but my firm's practice does include drafting lease agreements and some of my referral business does not name the referral in first contact. I primarily litigate and others handle transactional work (so why email me?) but did not want to outright ignore a potential client. After the first email I asked pointed follow-up questions to determine if it was legit before scheduling a call and got the exact detailed response posted by many above which seemed to answer all my initial questions. Lesson: these guys have learned how we follow up, what answers will be needed, and there is a template response ready.

    After a search of the companies, it struck me very odd that they did not have in-house counsel to do the drafting of the lease or at least that it was the "president" of the company who was in touch and not general counsel. Then I searched further and found this thread - thank you to the original poster for starting this thread and the many responses!

    I suppose the scam is that a subsequent check will be sent, money will be requested from that initial retainer/account payment, and then the check will bounce. However, does anyone know for sure? I am interested in how this plays out and how it is worthwhile for the scammers. I haven't looked on the rules of reporting, but maybe this is something we should be reporting to the State Bar. I don't know if the Bar (I'm in Texas) keeps tabs on this kind of thing as a service to members.

    6. I received an identical email from "Warren" on January 10. The website for Velox and the buyer of the equipment is legitimate business in Northwest Ohio. A week or so later I got a call and Warren had a very strong Asian accent and the phone connection was very bad, even though appearing to be from a US area code. Then came the cashier's check by Fed Ex and a Letter of Intent from Lawrence Global Advisors Inc., 1345 Avenue of the Americans (not Americas), NYC. Just got an email saying most of the money needs to be wired out tomorrow.

Primary red flags were the gmail account, a company website that looks scammy (though the company is registered), the fact that it was a cold email from out of state, a request for an engagement agreement without even confirming my rates, and the opening salutation was to my shortened first initial last-name from my email. Also - who says "for my perusal?" It had attachments but I did not open them. I imagine the scam is to make payment by a fake bank check and ask for a refund. That's the only thing I can think of...

  72. Yup, got the Yadkin Well email, said they were referred by the state bar. Our state bar does not have a referral service, so I knew right away. And confirmed it with the actual company. The scam is a repeat of a well-known ploy, they send you a check to deposit into your client trust account, then you are supposed to take your down payment and send them the net proceeds. They will press very hard to get your check right away, then they will cash your check immediately, before the check you deposited bounces. You are left to answer to your bank for the missing funds. I've probably received 7 or 8 of these in the last 5 years or so, they are pretty easy to recognize, but it probably works occasionally. Beware, they will continue, law enforcement either doesn't try or cannot stop them.

    The big red flag was in the first sentence..for the same reasons stated above - my state bar does not provide any contact/practice/referral info. Although suspicious, I do this type of work so I corresponded as I would any other but instantly found their eager request for a retainer to sign suspicious and requested they have a person in authority call me to discuss. Their response was for me to call them at the number listed below mon-fri 9-2pm. The numbers listed included a WhatsApp specific number which raised another red flag. Few red flags but still very convincing scam. Im grateful my google search/due diligence screening led right here. Shoutout to whoever made this!

    This email is to notify you that we are ready to retain your firm for the following services:

    Draft Lease agreement
    Amend lease agreement if the need arises
    Review of supporting documents for the lease
    Holding of offer deposit for the lease

    Payments would be made by Cashier's Check. Kindly send me your check payment details such as, Check payable to ( Firm Name As should be on the check), and preferable mailing address where cashiers check would be mailed to.

    I spoke with the broker for the Lease about the next steps. I will need to see an offer letter which should outline their preferred terms and procedure of the lease. I need to be sure we have a serious deal on ground before we start working on the lease agreement.

    They will be sending you a copy of the LOI and a holding deposit which includes your retainer fees that will be issued to your client trust account since you will be the attorney overseeing the transaction. A holding commitment deposit of between $100,000-$300,000 and a Letter of Intent are part of our requirements from a customer to avoid us from listening to other potential offers.

  113. Adam B Stone is now looking for an attorney in Hawaii! That was my first clue. Why would a NC company be renting equipment to a business in Hawaii. Lewis Well and Pump Repair is a real business in NC. But it looks like the scammer got his name wrong. According to public records the president is Bradley Adam Stone.
    I don’t get the scam though. If all he asks for is your firm’s name and address to send a cashier’s check, which is public information anyway, how does he steal from you?
