Heavy Metal

I am selling my 2015 Caterpillar D10T2  to a buyer residing in your state. I will need your skilled legal counsel to help me draft the sale agreement for the transaction from contract preparation through closing. The above mentioned 2015 Caterpillar D10T2 has a sales price of $876,000.  This includes the insurance cost, shipping and handling cost. Attached are required details of the Caterpillar  for your review.

Timing -Sale will be finalized once both parties have signed the sales agreement and full payment made.
Shipping - Buyer will take responsibility of shipping cost and also risk of damage.
Method of payment, and whether a deposit will be paid. This is a cash transaction. No Financing
No warranties. Equipment is sold AS IS', but a satisfactory inspection will be done and an appraisal issued by the inspection company.   4. I got this same email this week, but it was sent to me by a "Michael Guarino" at Hemphill Construction. He must have purchased the Caterpillar from Mr. Drake and is now looking to re-sell it to someone else . . .

  5. This law firm received an email this week from a "Michael Guarino" from Hemphill construction Company. When I asked him to give me a call so that I can collect additional information, he responded back to my email asking if he can send me a brief summary of the transaction to review. I googled his email and phone number as that was a red flag and found this forum. The irony is, apparently he sent this firm an email last year and went by the name of "Chris Drake". I thought this recent email looked familiar....

  11. We just got the same solicitation and it smelled funny so i started checking and found this thread. But they used the name of a colleague as the referring person so they are getting more sophisticated (although I will usually check with the referrer and thank them).

  12. We got two web contact cards from this same scammer. The fact that s/he gives a different phone number every time (that doesn't work), and uses different emails was a big clue. They won't do a phone appointment.

    There IS a Hemphill Construction at that address and this guy is listed as the Equipment Manager. The company is legit, but this guy only shows up on Zoominfo.com

  15. Same verbiage, he is now Jake Williams Construction of Boca Raton Florida and the Michael guy is his equipment manager. They posted an ad on lawyer.com that was referred to me and initially there was no mention of any kind of deposits payments through me so I signed an agreement with them for drafting a contract or a flat fee. Then they started talking about me getting paid through a third party or collecting some deposit and subtracting stuff so it raised my suspicions and I found this site. I never spoke to the guy and I never verified who he was which is a risk I can take for a few hours of drafting but not when assisting with any major transaction and what he was asking I don't do and I would never agree to it they also stepped up their game and now have a scope of work proposal they send out with corporate logos and everything

Michael Guarino is now the Equipment Manager for Jake Williams Construction (the guy claims to be Jake Williams) and the purchaser is in my state (MA). Here is his latest (and most detailed) email:

  20. He now goes by Daniel John of Bluetech Construction in Colorado. The scammers will use a legitimate company so when you look it up, it seems real even though something about the interaction seems off.

  22. As of today, scammer is still Daniel John with the caterpillar. He agreed to my $50,000 retainer and $995/hr. fee without a blink. He has a detailed website but its grammatical errors clued me in.
