Eric,
ReplyDeleteThank you for taking time to accept us as a new client. This email is to notify you that we are ready to retain your firm for the following services:
Draft Lease agreement
Amend lease agreement if the need arises
Review of supporting documents for the lease
Holding of offer deposit for the lease
Acting as escrow for closing if the need arises
Per your direction on your retainer agreement, I will start making arrangement for your retainer payment. Kindly send me your check payment details and mailing address.
I spoke with the broker for the Leasee about the next steps. I will need to see an offer letter which should outline their preferred terms and procedure of the lease. I need to be sure we have a serious deal on ground before we start working on the lease agreement.
They will be sending you a copy of the LOI and a holding deposit which will be issued to your client trust account since you will be the attorney overseeing the transaction. They have asked me to give them one week to put their finances and offer documents together, lets keep our fingers crossed and see if they are serious. I will be available for a quick call, anytime after 12 pm CST today or anytime tomorrow. Let me know what time works for you so I can book it on my calendar. I hope to hear from you soon.

Our firm got a similar request. I'm trying to understand the end game of this scam. What are they trying to obtain?
DeleteI went a little further with this than others apparently did. Despite my initial misgivings about the stilted language of the email (e.g., "involves a company in your state"), the companies referenced in the email all checked out as legitimate, so I sent an engagement letter and then received a signed copy back. A week or so later, I received a FedEx package with a "lease deposit" check for $300,000, along with an unsigned LOI that contained authorization/instructions for me deposit the $300,000 in our firm's trust account and then draft several large checks to various vendors (e.g., an engineer who was going to inspect the lease equipment, etc.) from the funds. At that point, I was sufficiently suspicious and found this website. I wrote my "client," terminating our representation, and returned the "check" back to the person on the FedEx return label.
DeleteI just got one. But what do they get out of it?

I am an attorney in Indiana and I received one of these emails as well -- initial email was from a gmail address and the second email was from what seemed to be a legit email address and the company's address and website checked out -- is anyone aware of these using fake websites? Also, any further thoughts on what they are after? I thought the email seemed odd, but after seeing these emails, it appears to be exactly the same approach, including the type of equipment referenced. Paul

I got a similar inquiry from ProLab Medical Solutions, LLC out of Oklahoma City. I am in Harrisburg, Pennsylvania. I am not responding to any e-mails that come in today or in the near future. I am quite suspicious. This "LLC" is not registered in Oklahoma. In an earlier e-mail, they asked for my banking information, which I did not provide. Just got one like this today! Reporting to the Oregon State Bar. HAHA!
ReplyDeleteDear Attorney,
ReplyDeleteI want to inquire if you draft business/lease agreements. Do let me know so I can provide more information. I found your contact info from the online bar directory. I would appreciate a referral if this is not your area of practice.
Please respond at your earliest convenience.
Regards,
Robert Moore
Thank you for getting back to me regarding my potential legal representation request. I want you to draft a commercial lease agreement between my company and Gregory Drilling Inc. Which is located in your state. We are negotiating the terms for a lease agreement for their upcoming contract. They are looking at the possibility of leasing my Subsea Well Intervention Equipment for a 12 months duration.
ReplyDeleteWe will require your services for the following:
Draft the lease agreement
Review the required documents for the lease
We will handle negotiations. We may need your advice on the legal part if the need arises.
The total value of the transaction will be around $3,400,000 which will be handled by my company. We were hoping to kick this off first week of May, due to the COVID19 outbreak we are uncertain about the closing date. I will provide you with our previous lease agreements which we have used in the past to make things move as fast as possible.
Send me a retainer agreement based on your hourly rate, I believe you will not exceed 20 hours on the whole project. My week is looking tied, we can schedule to discuss after I have reviewed your retainer agreement, and once we are set to have you start drafting the lease agreement. I look forward to hearing from you and working with you on this project. Let me know if you have any questions.

There is another one.
ReplyDeleteA prospective client contacts you seeking representation in a dispute. You do not know the client, but he emails you background documents on the dispute and confirms the details by phone. He signs your engagement letter.
ReplyDeleteAlmost immediately, the matter settles. The adverse party sends a large check, made out to you for the benefit of your client. You notify your client and deposit the check in your attorney trust account. Your client tells you that he needs the funds immediately and provides his wire information.
What do you do?
These are the facts of several currently circulating email scams targeting lawyers. There are several variations: One involves a claim for unpaid severance from an Ohio health care company; another involves the collection of overdue loan payments from a Massachusetts restaurant company. The purported adverse party is often a real company and the underlying documents put together with a sophisticated touch—there are no “Nigerian princes” involved. But the check is counterfeit and the goal of the scam is to cause the attorney to disburse funds before learning that the check is no good.
Does anyone know what payout scheme is on this scam?
ReplyDeleteRecently received the email below 9/19/22. Thought it looked fishy. Just copied and pasted it into search bar and found this thread. Clearly changed the names but basically the same letter. Hope this helps other attorneys avoid getting scammed. Thanks for the post.

I just received the same unsolicited email from Alex Cooper of Innersource Energy, and the "Lessee Conflict" was Paraco Gas Co in Rye Brook, a NY Corporation. What is the scam, what do they get from us? And would it be ethically frowned upon to contact the legit company lessee and advise that this is happening?

ReplyDeleteDavid,
Thank you for getting back to me regarding my potential legal representation request. I want you to draft a commercial lease agreement between my company and Price Oil Co. located in your state. They are looking at the possibility of leasing my DP3 Well Intervention Equipment for a 12 months duration for $3,400,000 and we are negotiating the terms for a lease agreement for their upcoming contract.
Lease documentation and financing options are currently being negotiated and it's incumbent upon me to retain a lawyer, to ensure the essential elements binding an agreement. I will be requiring your service with the following:
Draft the lease agreement
Review the required documents for the lease
We will handle negotiations. We may need your advice on the legal part if the need arises.
A better indication of your acceptance would be the provision of your retainer agreement, clearly stating the scope of your representation, billing rates or fees, and any special disclosures that may be appropriate.
My week is looking tied, we can schedule to discuss this after I have reviewed your retainer agreement, and once we are set to have you start drafting the lease agreement. I look forward to hearing from you and working with you on this project. Let me know if you have any questions.
