ReplyDeleteMr. __________,
As requested, attached is a copy of the loan agreement with Ryder Systems Inc.,3355 Aerial Way Drive Roanoke, VA 24018.
The last installment was supposed to be paid on 5th March, 2013. Payment deadline of 29th March, 2013 was agreed. However, the deadline date was extended to 30th of April, 2013 as requested for by our client. Quite unfortunately, the extended deadline was not honoured.
Despite the foregoing, I will like to draw your attention to the relationship with our client which has been cordial and we have had successful business relationship over the past few years, and it is our position to maintain the relationship after settling the issues on hand. Right now, I will like to take appropriate steps and measures to enforce our rights on the agreement and/ or claim damages as appropriate.
If your firm is retained, our expectation of your services for now will be within the scenario of a engagement letter to our client. This approach will trigger the much needed response from our client towards amicable settlement otherwise we will not hesitate to go into court litigation. We are prepared to pay your retainer fees.
Litigation may be introduced as a last resort when options have been exhausted. We look forward to your prompt response and you may send your retainer document as well.
Sincerely,
Fabien Derville

ReplyDeleteOriginal email:
ReplyDeleteDear Counsel,
I wish to file a case against my ex-spouse for failure to make court ordered
payments of Child, spousal and medical support. Please reply via: hanakosimmons@att.net
Regards,
Ms Simmons
(I replied, telling her to call me if she wanted a consultation)
Her response:
Thank you for your prompt response. Sorry for the delay. Am in Japan for an assignment and Konami Simmons (ex spouse) lives in __________________. Due to the time difference (+13hrs EST) it is a little bit difficult to determine the best time to call you. Following our divorce, we agreed under a negotiated settlement agreement which is incorporated, merged into and made part of the court decree for a onetime cash settlement of $557,000.00USD for Family support (this includes child support, alimony and medical support). To his credit, he has paid me $208,000.00USD from a total of $557,000.00 but still owing $349.000.00USD and the due time for completion of payment is over. Thus, I request your legal counsel and representation to enforce the final judgment thereby compelling him to remit the balance owed me. He is aware of my intention to seek legal actions. Attached is a copy of the separation agreement, and Final Judgment and I will be pleased to provide further information on this case on request. I desire to retain your law firm, please forward your firm's retainer fee agreement so that we can proceed. Thank you and have a pleasant day.
Regards,
Hanako Simmons

I received the same email as well, minus the passport copy.
DeleteThe "Japanese Court" documents were obviously fake.
I am contacting your firm in regards to a breach of contract matter with a client in your locality.
ReplyDeleteDo let me know if you are currently accepting new clients.
Thank you,
Fabien Derville
I got this same email on the same day.
ReplyDeleteGot the same one from Fabien today. Did not respond because though it was odd that came in on a gmail address and when you click reply if goes to a yahoo address.
ReplyDeleteI also got an email with the same lingo. The person (whoever it is) emailed a passport with a photo of the purported "Hanako Simmons" and a phony divorce decree and separation agreement.
ReplyDeleteI just got the Fabien Derville one as well, it is a variation on both the Japanese divorce client property settlement scam and the industrial note collection matter. I write them back and let them know I've contacted the FBI and Interpol and link to pages such as this one where their scam is exposed.
