They are looking into leasing my Subsea Well Intervention &; Drilling Equipment. We are at the closing stages of the verbal negotiation process, so they have requested for me to retain a lawyer that will prepare the lease agreement.     Thank you for taking time to accept us as a new client. This email is to notify you that we are ready to retain your firm for the following services:

    Draft Lease agreement
    Amend lease agreement if the need arises
    Review of supporting documents for the lease
    Holding of offer deposit for the lease
    Acting as escrow for closing if the need arises

    Per your direction on your retainer agreement, I will start making arrangement for your retainer payment. Kindly send me your check payment details and mailing address.

    I spoke with the broker for the Leasee about the next steps. I will need to see an offer letter which should outline their preferred terms and procedure of the lease. I need to be sure we have a serious deal on ground before we start working on the lease agreement.

    They will be sending you a copy of the LOI and a holding deposit which will be issued to your client trust account since you will be the attorney overseeing the transaction. They have asked me to give them one week to put their finances and offer documents together, lets keep our fingers crossed and see if they are serious.       I went a little further with this than others apparently did. Despite my initial misgivings about the stilted language of the email (e.g., "involves a company in your state"), the companies referenced in the email all checked out as legitimate, so I sent an engagement letter and then received a signed copy back. A week or so later, I received a FedEx package with a "lease deposit" check for $300,000, along with an unsigned LOI that contained authorization/instructions for me deposit the $300,000 in our firm's trust account and then draft several large checks to various vendors (e.g., an engineer who was going to inspect the lease equipment, etc.) from the funds. At that point, I was sufficiently suspicious and found this website. I wrote my "client," terminating our representation, and returned the "check" back to the person on the FedEx return label.

    I am an attorney in Indiana and I received one of these emails as well -- initial email was from a gmail address and the second email was from what seemed to be a legit email address and the company's address and website checked out -- is anyone aware of these using fake websites? Also, any further thoughts on what they are after? I thought the email seemed odd, but after seeing these emails, it appears to be exactly the same approach, including the type of equipment referenced. Paul

    I practice in florida and i received correspondence which tracks all of the above, including the most recent one from Prevail Energy Ltd (also valued at $6.9mm). My correspondence came from Alain Mizelle (CEO), not John Pedora (VP), both of whom are listed as officers of the company in the Canada and Quebec registries and Prevail website. Mizelle has not volunteered a phone number, and the one on public records does not work.

    My company is on the verge of leasing 20 Ventilators to a Pharmaceutical company in your state. We want you to review the lease agreement, amend it to your state laws and make correction if the need arises. They are looking at leasing the Ventilators for 12 months and a possibility to extended if the Covid-19 cases rise up by next summer.

    We will require your services for the following:

    The total value of the Ventilators is about $1,200,000. The lease payments will be broken in monthly payments, we are hoping to close on this by Febuary or before the end of March.     Almost immediately, the matter settles. The adverse party sends a large check, made out to you for the benefit of your client. You notify your client and deposit the check in your attorney trust account. Your client tells you that he needs the funds immediately and provides his wire information.


    What do you do?

    These are the facts of several currently circulating email scams targeting lawyers. There are several variations: One involves a claim for unpaid severance from an Ohio health care company; another involves the collection of overdue loan payments from a Massachusetts restaurant company. The purported adverse party is often a real company and the underlying documents put together with a sophisticated touch—there are no “Nigerian princes” involved. But the check is counterfeit and the goal of the scam is to cause the attorney to disburse funds before learning that the check is no good.
